Overseas Citizen of India (OCI) Card

A) Eligibility:

The eligibility for the issue of OCI card to an applicant is as follows:

(a) Any person of full age and capacity,

  • Who is a citizen of another country, but was a citizen of India at the time of, or at any time after, the commencement of the Constitution i.e. 26th January 1950; or
  • Who is a citizen of another country, but was eligible to become a citizen of India at the time of the commencement of the Constitution i.e. 26th January 1950; or
  • Who is a citizen of another country, but belonged to a territory that became part of India after 15th August, 1947; or
  • Who is a child or a grand-child or a great grand-child of such a citizen; or

(b) A person, who is a minor child of a person mentioned in the clause (a) above (i-iv); or

(c) A person, who is a minor child, and whose both parents are citizens of India; or one of the parents is a citizen of India; or

(d) Spouse of foreign origin of a citizen of India and whose marriage has been registered and subsisted for a continuous period of not less than two years immediately preceding the presentation of the application under this section; or

(f) Spouse of foreign origin of an Overseas Citizen of India cardholder registered under section 7A and whose marriage has been registered and subsisted for a continuous period of not less than two years immediately preceding the presentation of the application under this section.

Note: Such spouse shall be subjected to prior security clearance from a competent authority in India:

B) Revised guidelines for re-issuance of Overseas Citizen of India (OCI) cards:

Government of India has revised instructions/guidelines of “Re-issuance of OCI cards due to Issuance of new foreign passports to OCI cardholders”.

  1. Mandatory requirement of re-issuance of an OCI card each time a new passport is issued to a foreigner upto20 years of age and once after completing 50 years of age is dispensed with.
  2. OCI cardholder is required to get the OCI card re-issued only once when a new passport is issued after completing 20 years of age so as to capture his/her facial features.
  3. OCI cardholder is required to upload ONLINE a copy of the new passportand a latest photo each time a new passport is issued upto 20 years of age and once after completing 50 years of age. The uploading of these documents on the OCI portal may be within three months of receipt of the new passport. The service will be provided on Gratis(no cost/free) basis.
  4. Foreign spouse of an Indian Citizen or spouse of foreign origin of an OCI cardholder are required to upload a copy of the new passport and also a latest photo ONLINE each time a new passport is issued along with a declaration on subsisting of marriage, copy of the Indian passport of the Indian passport of the Indian spouse/passport & OCI card of the OCI cardholder spouse.

C) How to apply:

New application for registration as OCI, re-issue of OCI card, and application for OCI Card in lieu of existing valid PIO card can all be made online. The completed application forms along with the required documents are then to be submitted to the High Commission of India, Port Louis.

  • One copy of Ancestor’s Document –obtained from MGI (Moka) Archives Mauritius or National Archives Mauritius with original
  • One copy of Passport(s) of applicant and spouse with original
  • One copy of Marriage Certificate (if applicable) with original

  • Joint Affidavit from Supreme Court or Lawyer giving details of applicant’s marriage claiming that applicant is still in marriage relationship with the respective OCI or Indian passport card holder.
  • One copy of Passport of applicant and spouse  with original
  • One copy of Spouse Indian passport/OCI card with original (1st and last page)
  • One copy of Marriage Certificate (A4 format) – apostille by the Prime Minister’s Office and Ministry of Foreign Affairs with original
  • One copy of Applicant’s Birth Certificate (A4 format) with original
