Solemnization/ Registration of Marriage

(A) Solemnization and Registration of Marriage under Foreign Marriage Act, 1969

  1. Submission of notice of Intended Marriage

Conditions:

At least one of the two, prospective bride or bridegroom, must be an Indian National and a legal resident within the jurisdiction of the High Commission of India in Mauritius. The Indian national needs to submit a Certificate of Bachelorhood/ Single-status.

[A Certificate of bachelorhood/single-status/eligibility to get married can be issued by a competent court/ SDM having jurisdiction of the area of the residential address of the applicant. This can be in the form of a certificate/ affidavit notarized by SDM which is required to be counter-attested by the Home Department of the State concerned. Thereafter, it is to be attested/apostilled by the Attestation Section of the Consular, Passport & Visa (CPV) Division of the Ministry of External Affairs, New Delhi.

If either of the two is a non-Indian National, he/she has to get a ‘No Objection Certificate’ from the concerned authority or an affidavit declaring his/her marital status and willingness to marry an Indian National, duly attested by the concerned authority (in his/ her country).

  • Three witnesses, who are Indian Nationals and hold valid Mauritian Resident Permit, must be physically present along with prospective bride and bridegroom at the time of submission of notice of intended marriage and also during solemnization and registration.

List of Documents Required:

  • Completed "Misc. Services" application form with one passport size photo affixed in the box.
  • Original Passport of all the five individuals (Bride, Bridegroom and 3 witnesses) + 1 Photocopy (first & last page) of each.
  • Copy of Proof of address (utility bill, driver license or lease agreement) of all five individuals.
  • Copy of valid Visa/Resident Permit/Id. card issued by Mauritian government, if any, of all five individuals.
  • Notice of intended marriage (4 copies)(Form-I)
  • Declaration by prospective bride and bridegroom in duplicate (2 Copies) (Form-II).
  • Four identical, passport size, recent, photographs each of prospective bride and bridegroom.

Fee Applicable      MUR-2400/- (Service fee- MUR-2300/- + ICWF 100/- ).

  1. Advertisement of Intended Marriage

After submission of notice of intended marriage, advertisements are to be published by the individuals in a local newspaper as well as an English newspaper in the place of permanent residence indicated in the passport in India/ concerned country. The text of advertisement is as under:

Mr. ______________________ holder of _________________(name of country), Passport No. _____________ and Miss ___________________________________ holder of __________(name of country) Passport No. ________________________________ intend getting married at the High Commission of India, Port Louis, Mauritius under the Foreign Marriage Act, 1969 of India. Objections, if any, may be conveyed to the High Commission of India, Mauritius within 30 days of publication of this notice at the email id. cc.portlouis@mea.gov.in

(All the particulars must be filled in exactly as per the passports.)

  • Original full page of the newspapers in which the advertisements were published should be presented to Consular officer within 30 days of submission of notice of intended marriage.
  1. Date of Marriage

Marriage has to be solemnized within six months from the date of notice of intention of marriage presented to the marriage officer, failing which the entire procedure should be repeated if the parties intend to proceed with the marriage.

  • Marriage officer will consult with the applicant for a convenient date of marriage.
  1. Solemnization and Registration of Marriage

Three witnesses who were present at the time of submission of notice of intended marriage should be present at the time of marriage solemnization and registration. Please seek prior appointment with the Marriage Registrar for this purpose.

  • All the five persons must present their original passports at the time of marriage solemnization and registration.

 

(B) Registration of Marriage under section 17 of Foreign Marriage Act, 1969

Document required for Registration of Marriages solemnized in the local court in Mauritius:

  • Completed "Form-III" application forms with one passport size photo affixed.
  • Completed "Misc. Services" application form with one passport size photo affixed in the box.
  • Original Passport of all the five individuals (Bride, Bridegroom and 3 witnesses) + 1 Photocopy (first & last page) of each.
  • Copy of Proof of address (utility bill, driving license or lease agreement) of all five individuals.
  • Copy of valid Visa, Resident Permit and Id card issued, if any by the Mauritian government, of all five individuals.
  • Marriage Certificate and letter from both parties requesting registration of their marriage at the High Commission.
  • Two identical, passport size, recent, photographs each of prospective bride and bridegroom.

Fee Applicable       MUR-2400/- (Service fee- MUR-2300/- + ICWF 100/-).

Three witnesses who are Indian Nationals and hold valid Mauritian Resident Permit, must be physically present along with both parties at the time of marriage registration. They may seek prior appointment with Marriage Officer/Registrar for this purpose.
